利用規約
この利用規約（以下、「本規約」といいます）は、開発者（以下、「当方」といいます）が提供する macOS 用アプリ「PhoTriage」（以下、「本アプリ」といいます）の利用条件を定めるものです。ユーザーの皆さま（以下、「ユーザー」といいます）には、本規約に従って本アプリをご利用いただきます。
第1条（適用と同意）
本規約は、ユーザーと当方との間の本アプリの利用に関わる一切の関係に適用されるものとします。
ユーザーは、本アプリを端末にインストールし、利用を開始した時点で、本規約に同意したものとみなされます。
第2条（禁止事項）
ユーザーは、本アプリの利用にあたり、以下の行為をしてはなりません。
- 法令または公序良俗に違反する行為
- 犯罪行為に関連する行為
- 当方、他のユーザー、または第三者のサーバーまたはネットワークの機能を破壊したり、妨害したりする行為
- 本アプリの運営を妨害するおそれのある行為
- 本アプリをリバースエンジニアリング、逆コンパイル、または逆アセンブルする行為
- その他、当方が不適切と判断する行為
第3条（免責事項）
当方は、本アプリに事実上または法律上の瑕疵（安全性、信頼性、正確性、完全性、有効性、特定の目的への適合性、セキュリティなどに関する欠陥、エラーやバグ、権利侵害などを含みます）がないことを明示的にも黙示的にも保証しておりません。
当方は、本アプリに起因してユーザーに生じたあらゆる損害（写真データや XMP サイドカーの消失・破損、端末の故障、機会の喪失などを含みます）について、一切の責任を負いません。
本アプリの利用（写真のセレクト、判断内容の XMP サイドカーへの書き出し等）については、ユーザー自身の責任において行うものとします。重要なデータは事前にバックアップを取ることを強く推奨します。
第4条（利用規約の変更）
当方は、必要と判断した場合には、ユーザーに通知することなくいつでも本規約を変更することができるものとします。なお、本規約の変更後、本アプリの利用を開始した場合には、当該ユーザーは変更後の規約に同意したものとみなします。
第5条（準拠法・裁判管轄）
本規約の解釈にあたっては、日本法を準拠法とします。
本アプリに関して紛争が生じた場合には、東京地方裁判所または東京簡易裁判所を第一審の専属的合意管轄裁判所とします。

Terms of Service
These Terms of Service ("Terms") govern the terms and conditions for using the macOS application "PhoTriage" ("the App") provided by the developer ("Developer"). Users ("Users") must use the App in accordance with these Terms.
Article 1 (Application and Consent)
These Terms apply to all relationships concerning the use of the App between the User and the Developer.
By installing the App on a device and starting its use, the User is deemed to have agreed to these Terms.
Article 2 (Prohibitions)
When using the App, Users must not engage in the following acts:
- Acts that violate laws and regulations or public order and morals
- Acts related to criminal behavior
- Acts that destroy or interfere with the functionality of the servers or networks of the Developer, other users, or third parties
- Acts that may interfere with the operation of the App
- Acts of reverse engineering, decompiling, or disassembling the App
- Other acts that the Developer deems inappropriate
Article 3 (Disclaimer)
The Developer does not guarantee, either expressly or implicitly, that the App is free from de facto or legal defects (including defects related to safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security, etc., errors, bugs, or infringement of rights).
The Developer shall not be liable for any damages (including loss or corruption of photo data or XMP sidecars, device failure, loss of opportunity, etc.) incurred by the User arising from the App.
The use of the App (such as culling photos and writing decisions to XMP sidecar files) is carried out at the User's own responsibility. We strongly recommend backing up important data beforehand.
Article 4 (Modification of Terms)
The Developer may modify these Terms at any time without prior notice to the User if deemed necessary. If the User starts using the App after the modification of the Terms, the User is deemed to have agreed to the modified Terms.
Article 5 (Governing Law and Jurisdiction)
The interpretation of these Terms shall be governed by Japanese law.
In the event of a dispute regarding the App, the Tokyo District Court or the Tokyo Summary Court shall be the exclusive court of first instance.
